PRE-BANKRUPTCY CREDIT COUNSELING
Before being permitted to file for Bankruptcy an individual must complete an approved credit counseling program. If a husband and wife file jointly both must complete the credit counseling program. BAPCPA requires that you be made aware of possible nonbankruptcy options for dealing with your financial problems before you are permitted to file for bankruptcy. During the first phase of the program we will assist you in preparing a budget. This will be done online and will require you to enter some basic financial data. The second phase involves a lecture in which we discuss factors which lead to credit problems and the various options which might be available to you. The purpose of this is to make you aware of nonbankruptcy options but there will be an overview of the bankruptcy process. At the end of the program you should have the information necessary to make an informed decision on what course of action is best for you. The process takes about 90 minutes and at the conclusion a trained counselor will call you to discuss any question you may have and once your concerns are addressed will issue your certificate which you will need if you decide to file for bankruptcy. The certificate is valid for 180 days from date of counseling.
